1. Definitions

“HireFlow Direct” refers to YourRecruit Ltd trading as HireFlow Direct.

“Client” refers to the purchaser of HireFlow Direct services.

“Candidate” refers to any applicant responding to a job advertisement placed by HireFlow Direct.

“Services” refers to job advertising and related support provided under HireFlow Direct.

2. Services Provided

HireFlow Direct provides a job advertising service only. This includes:

  • Creation, optimisation and/or distribution of job advertisements
  • Promotion across selected job boards, social platforms and networks
  • Optional enhancement services depending on the selected package

HireFlow Direct does not act as an employment agency or employment business under this service and does not:

  • Screen, interview or select candidates unless expressly agreed in writing
  • Carry out compliance checks
  • Manage the recruitment process beyond advertising

All candidate applications are sent directly to the Client.

3. Client Responsibilities

The Client agrees to:

  • Provide accurate, lawful and non-discriminatory job descriptions and company information
  • Ensure the role and advert comply with all applicable UK employment laws
  • Handle all candidate communication, selection, interviewing and hiring
  • Carry out all necessary compliance checks, including but not limited to:
    • Right to work verification
    • References
    • DBS checks (where applicable)
    • Qualification verification

HireFlow Direct reserves the right to remove an advertisement without refund if the posting is found to be misleading, unlawful, discriminatory, or in breach of any job board’s terms and conditions. HireFlow Direct accepts no liability for any hiring decisions made by the Client.

4. Fees & Payment

  • All fees are quoted exclusive of VAT. VAT will be added at the prevailing rate and shown at the point of purchase.
  • All fees are payable in advance at the point of purchase.
  • All fees are non-refundable once payment has been received and the service has commenced, except in the event of non-delivery by HireFlow Direct.
  • Pricing is based on the selected service tier at the time of purchase. Current pricing is set out below:

Prices are subject to change. The fee applicable is that shown at the time of purchase.

No additional recruitment fees apply unless a separate written agreement is entered into for full recruitment services.

5. Candidate Ownership & Introduction

All candidates who apply via HireFlow Direct advertisements are considered to be direct applicants to the Client.

HireFlow Direct does not claim ownership of candidates introduced under this service.

If the Client wishes to engage HireFlow Direct for full recruitment services in respect of any candidate, this must be agreed separately in writing under standard YourRecruit Ltd recruitment terms.

6. Service Delivery

  • HireFlow Direct will use reasonable endeavours to publish advertisements promptly following receipt of all required information and cleared payment
  • Advertisement run times are determined by the package selected (see Section 4 table above) and commence from the date of first publication
  • Where additional input is required (e.g. enhanced or managed packages), Hire Flow Direct will contact the Client to discuss requirements before publication
  • Timescales may vary depending on submission time, weekends, bank holidays and availability of information from the Client

HireFlow Direct does not guarantee:

  • The number of applications received
  • The quality or suitability of candidates
  • A successful hire outcome

7. Liability

To the fullest extent permitted by law:

  • HireFlow Direct shall not be liable for any loss, damage, cost or expense arising from the use of the service
  • This includes, but is not limited to: failure to hire, candidate suitability or conduct, or business interruption
  • HireFlow Direct’s total liability in connection with any single matter shall not exceed the fee paid by the Client for the relevant service

The Client remains solely responsible for all hiring decisions and for compliance with employment law.

8. Data Protection

Both parties agree to comply with the UK GDPR and all applicable data protection legislation.

  • HireFlow Direct acts as a data processor for the purposes of advertising only
  • The Client acts as the data controller for all candidate data received directly from applicants

Candidates apply directly to the Client. The Client is solely responsible for the lawful handling, storage and processing of that data in accordance with UK GDPR.

9. Intellectual Property

Where HireFlow Direct creates advertisement content on behalf of the Client (Campaign Enhance and Campaign Managed packages only), HireFlow Direct retains intellectual property rights in that content until full payment is confirmed.

Upon receipt of cleared payment, the Client is granted a non-exclusive licence to use the advertisement content for the purposes of the relevant recruitment campaign only.

For the Campaign Launch package, where the Client supplies their own advertisement content, the Client retains all intellectual property rights in that content.

10. Complaints

HireFlow Direct is committed to providing a professional service. If a client has a complaint regarding the service, the following process applies:

  • Complaints should be submitted in writing to hello@hireflow.co.uk as soon as reasonably possible after the issue arises
  • HireFlow Direct will acknowledge the complaint within 3 working days
  • A full response will be provided within 10 working days of receipt
  • Where a complaint cannot be resolved within 10 working days, HireFlow Direct will keep the Client informed of progress and provide an expected resolution date

11. Variation

HireFlow Direct reserves the right to update or amend these Terms of Business at any time. Clients will be given reasonable notice of any material changes. Continued use of the service following notification of changes constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Business are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
